An effective set of Terms and Conditions is an important part of maintaining your Business and protecting your investment.
The Bed & Breakfast and Farmstay Association NSW and ACT have posted examples of Terms and Conditions as a resource for Members. These examples are available in our members only area (requires login), and have been kindly provided by some of our Members with a generic set included after crawling the Internet to find the most commonly used clauses.
These Members have provided the rationale behind their Terms and conditions, which can range from experience with ill behaved guests to clarity and the simple approach all the way through to the full legal ambit.
Whichever way it goes it is up to the individual to decide which terms and conditions to include and which approach to take. Whatever approach is undertaken, it is vital that Terms and Conditions be communicated to the Client prior to obtaining any deposit and their acceptance is obtained so that you are covered. Even if you have your Terms and Conditions in your confirmation letter, it will not stand up in court if queried and the confirmation letter was sent after the deposit was received.
